SERVICES
DESCRIBED BELOW. BY USING THESE SERVICES, YOU ACKNOWLEDGE
THAT YOU HAVE AGREED TO BECOME A PARTY TO AND LEGALLY BOUND BY THESE
TERMS AND CONDITIONS. IF YOU DO NOT WISH TO BE BOUND BY THESE TERMS
AND
CONDITIONS, YOU MAY NOT ACCESS OR OTHERWISE USE THESE SERVICES.

Order Completion Timeline and Service Policy
Consumer And Photographer Service Agreement
1. Upon receipt
of email confirmation indicating that a virtual tour order
has been successfully submitted. A 360homepictures.com Photographer
will make contact with the client within
two business days ( excluding
weekends and holidays ) to schedule the virtual tour shoot and
to determine
areas to be photographed.
2. An
agent or homeowner is required to be present at the time of
the shoot.
If the home or business has a gated entrance the agent or homeowner
will
meet the photographer at the gate. If the photographer arrives
and the agent
or homeowner is not at the gate. The photographer will wait
15 minutes, and
then leave, and a $35.00 no-show fee will be charged
to the customer.
3. For
Commercial Virtual Tour orders, it is required that the photographer
confirm the scheduled appointment with the appropriate client
representative
at least 24 hours prior to the appointment.
If the Virtual Tour shoot is unable to be scheduled within one
week the photographer
will notify 360homepictures.com.
4. If
for some reason the Virtual Tour shoot is unable to be scheduled
at all, the
appropriate client representative should contact 360homepictures.com
5. The
Real Estate Virtual Tours will only be posted to the 360homepictures.com
web site upon receiving all required information as specified
at the time of scheduling.
360homepictures.com is not responsible for any delays that are
a result of
missing information. The information includes but not limited
to
any asking price, the address, the number of bedrooms and bathrooms,
the square
footage, etc.
6. Once
the Virtual Tour has been processed the photographs will be
posted to a
unique Internet address on the 360homepictures.com web site
within two days.
The URL to the tour will be sent to the email address given
to 360homepictures.com.
The URL can be used to create a link to your own personal web
site. Notwithstanding the
foregoing every effort will be made to post the photographs
within the 24-hour period.
7. If
the client does not receive a "Completion of Virtual Tour
Order" email by the
two day deadline as defined above, please contact 360homepictures.com
Customer
Service department at CustomerService@360homepictures.com
8. All
images and media are the sole property of 360homepictures.com.
360homepictures.com reserves the right to these images, media
and content.
All images and media are made available to the client until
property is sold, listing
expires or 6 months, whichever comes first ( Unless otherwise
specified in writing ).
Cancellation, No Show, Reschedule,
Retake, Inclement Weather Policy
1. If
the property has been sold and 360homepictures.com is provided
with proof of such
sale more than 24-hours before the scheduled shoot, the cancellation
fee will be waived.
2. Any
Virtual Tour Order cancellation made less than 24-hours in advance
of the scheduled
shoot will incur a $25.00 fee to the customer. Any Virtual Tour
Order cancellation must be
made through the 360homepictures.com Customer Service department
at
CustomerService@360homepictures.com.
3. Either
the client, and authorized representative appointed by the client,
or homeowner
must attend the shoot. If the Photographer arrives at the property,
and the designated person
is not in attendance by the appointed time, the photographer
will wait 15 minutes, after that
time a $35.00 no-show fee will be charged to the customer. If
the designated person is
unable to attend the shoot, and the Photographer is granted
permission to enter the property,
the decision to complete the shoot will be the Photographer's
sole discretion. If the
Photographer elects not to shoot the property, the decision
will be binding and has been
made based on safety and liability concerns. The $35.00 no-show
will apply in this case.
4. To
reschedule a Virtual Tour shoot, contact 360homepictures.com
Customer Service at
CustomerService@360homepictures.com,
or your 360homepictures.com Photographer, no
less than 24-hours in advance of the original appointment. If
customer reschedules after this
it is considered a cancellation, and a $25.00 fee will be charged
to the customer.
5. The
360homepictures.com Photographer will shoot the home or business
as is. That is,
the photographer will not move objects, straighten or dust objects,
open or shut windows or
doors, make beds, clear counters, wash dishes, etc. The photographer
will however, turn
lighting on or off and open or shut blinds if it results in
better images.
6. If
the appearance of any photograph is unsatisfactory. 360homepictures.com
will
review it to determine whether a retake is necessary and who
will incur the expense
of the retake. 360homepictures.com reserves the right to have
final decision
on such retake requests. Retakes based on issues other than
photo quality are
subject to an additional $40.00 fee to the customer if the client
was not present
at the original shoot. Retakes necessary due to quality issues
clearly resulting
from incorrect camera settings will be retaken at no additional
cost. If the client
does not personally attend the shoot, this will prevent client's
ability to provide
artistic input and will void the right to request retakes for
reasons other than
quality issues at no additional charge.
7. Any
cancellations due
to weather except extreme circumstances such as flood,
fire, earthquake, etc. Because of safety and liability issues,
scheduled shoots may
be delayed or rescheduled due to inclement weather at Photographer's
sole discretion.
If the shoot is unable to be rescheduled there will be no charge
for the cancellation.
8. 360homepictures.com
Virtual Tours are active for 180 days from the date of
completion ( Unless prior arrangements have been made in writing
). After that
time period, unless otherwise specified, the tour will become
inactive and the tour
link will no longer work. If the customer would like the tour
reactivated a $20.00
reactivation fee will apply.
9. Once
the photographer has photographed a home, the tour may not be
cancelled.
The client will be charged the full price of the tour.
10. If
the MLS number of the tour changes and the customer would like
the
tour re-listed, a $20.00 re-listing fee will apply. This fee
does not include any
fees charged by the various portal sites to repost to their
web sites.
11. This
policy is subject to change without notice.
